These Terms of Service govern your use of the AERA ACTIVE website and purchases made through it.

Throughout these Terms, "AERA ACTIVE", "AERA", "we", "us" and "our" refer to AERA ACTIVE LTD, trading as AERA ACTIVE.

By using our website or purchasing from us, you agree to these Terms.

Nothing in these Terms affects your statutory rights as a consumer.

We make reasonable efforts to display and describe our products accurately.

Product colours may appear slightly different depending on your screen, device and lighting.

Measurements, weights and dimensions may be approximate unless expressly stated otherwise.

Product packaging may also change from time to time.

These provisions do not affect your rights where goods are not as described or otherwise fail to conform to your legal rights.

3. Product Use

AERA ACTIVE products should be used appropriately and in accordance with any instructions, warnings or guidance supplied with the product.

Exercise and Pilates equipment should be inspected before use and should not be used if it appears damaged or unsafe.

Nothing on our website is intended to constitute medical or professional healthcare advice.

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

4. Orders

Placing an order constitutes an offer to purchase products from us.

After placing your order, you will normally receive an order confirmation email.

We may refuse or cancel an order where there is a legitimate reason to do so, including where:

A product is unavailable;
There is an obvious pricing or product information error;
We cannot authorise your payment;
We reasonably suspect fraudulent activity; or
We cannot deliver to the address supplied.

Where we cancel an order after taking payment and you are entitled to a refund, we will refund the relevant amount.

5. Prices

Prices displayed on our website are shown in the currency indicated.

Applicable taxes will be included or displayed as required by law.

Delivery charges, where applicable, will be shown before you complete your order.

We may change prices at any time, but this will not normally affect an order already accepted by us.

6. Payment

Payment must be made using one of the payment methods offered at checkout.

You confirm that you are authorised to use the payment method provided.

7. Discount Codes and Promotions

Promotional codes are subject to their individual terms.

Unless otherwise stated:

Only one promotional code may be used per order;
Promotional codes cannot be exchanged for cash;
They cannot normally be applied retrospectively; and
Promotions may have an expiry date and eligibility requirements.

We may refuse use of a promotional code where it is invalid or used contrary to its stated terms.

8. Delivery

Delivery information is set out in our Shipping Policy.

Where no different delivery period has been agreed, goods will be delivered within the timeframe required by applicable law.

9. Returns and Cancellations

Your cancellation and return rights are explained in our Return & Refund Policy.

Nothing in these Terms limits your statutory consumer rights.

10. Pre-Orders

Products marked as pre-order will include an estimated availability, dispatch or delivery timeframe.

If this changes materially, we will communicate with affected customers and provide any rights or options required by applicable law.

Unless otherwise stated, the content of this website, including our branding, photographs, graphics, designs, text and other original material, is owned by or licensed to AERA ACTIVE.

You may use the website for personal, non-commercial purposes.

We aim to keep our website available and accurate but cannot guarantee uninterrupted access.

We may modify, suspend or discontinue website functionality where reasonably necessary.

This includes liability that cannot legally be excluded for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to goods.

We are not responsible for losses that were not reasonably foreseeable consequences of our breach or for business losses suffered by a consumer using products for purposes relating to a trade, business or profession, to the extent permitted by law.

The version applicable to your purchase will generally be the version in effect when your order is placed.

If you are a consumer resident in the UK, these Terms are governed by the applicable laws of the UK jurisdiction in which you live, and you retain any mandatory rights regarding where proceedings may be brought.
